JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One country made pistol and two live cartridges are said to have been recovered from conscious possession of the petitioner when he was arrested by the police from his house in connection with Manjhi P.S.Case No. 228 of 2015. The contention on behalf of the petitioner is that nothing has been recovered from conscious possession of the petitioner and the so called recovery of firearm is nothing but is highhandedness of the police.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with
Patna High Court Cr.Misc. No.7916 of 2016 (2) dt.19-02-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Rivilganj P.S.case No. 212 of 2015.
