The petitioner seeks regular bail in connection with Parbatta P.S. Case No. 398 of 2015, registered for the offence punishable under Sections 304(B) and 201/34 of the Indian Penal Code.
The allegation is regarding the accused persons having killed the victim lady on account of non fulfillment of the demand for dowry.
The learned counsel for the petitioner submits that the petitioner is the brother-in-law of the husband of the victim lady and has got nothing to do with the alleged incident and he is staying separately from his brother-in-law i.e. the husband of the victim lady. It is further submitted that
Patna High Court Cr.Misc. No.2361 of 2019(2) dt.18-01-2019 2/2 if there is complicity of anyone, it is that of the husband of the victim lady, who is in custody, hence, no prejudice would be caused if the petitioner is granted bail. The petitioner is stated to be in custody since 24.10.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Parbatta P.S.
