JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, his name came in confessional statement of co-accused and, thereafter, petitioner was arrested but he has not been put on Test Identification Parade though he is in jail custody since 18.12.2015.

So far as criminal antecedent of the petitioner is concerned, it is submitted on behalf of the petitioner that one Vikash Tiwary, who happens to be relative of the petitioner, had filed complaint case against the police official and that is the reason of false implication of the petitioner in several cases. Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.9712 of 2016 (2) dt.01-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Itarhi P.S. Case No. 110 of 2015.
