JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 14.12.2015 in a case registered for the offences punishable under sections 307, 498A/34 of the IPC.

The prosecution case is that the petitioner being husband of informant sold land for consideration amount of Rs. eight lacs but since he was alcoholic the informant demanded consideration amount for saving then he sprinkled kerosene oil and lit fire to the body of informant.

It is submitted by learned counsel for the petitioner that though the informant received 58% burn injuries but she is living with the petitioner and she retracted from her earlier version and

Considering the present stand of the informant, let the above named petitioner be released on provisional bail for three months on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Muffasil (Singhaul) P.S. Case No. 479 of 2015. The provisional bail of the petitioner will be confirmed by learned court below if, after appearance before the learned court below, the informant admits that she has filed compromised petition but if she denies the factum of compromise then petitioner will surrender and will renew the prayer for bail after remaining in custody for seven months.
