====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-03-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Turkauliya (Banjariya) P. S. Case No. 1205/2022 in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a), 32, 34, 36 of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 30 liters county made liquor was recovered from the river side.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is in custody since 14.11.2024.

Patna High Court CR. MISC. No.3950 of 2025(2) dt.05-03-2025 2/2 Charge-sheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the nature of accusation, period of custody and other facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, East Champaran, Motihari in connection with Turkauliya (Banjariya) P. S. Case No. 1205/2022.
