JUSTICE GOPAL PRASAD ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 06.07.2015 in connection with Mithanpura P.S. Case No. 1 of 2015 registered for the offences punishable under Sections 363, 365 and 34 of the Indian Penal Code.

Prosecution case in brief is that on 29.12.2014 at about 12:300 p.m. one Amar Kumar took the informant's son Mani Prabhas, aged about 12 years, on the pretext of excursion towards BMP-6 and till late night they did not return and on enquiry, the informant came to know that they went to Nepal. It is further alleged that on query from elder sister Meena Devi (petitioner herein), she reluctantly gave mobile number of Amar Kumar and

Patna High Court Cr.Misc. No.8834 of 2016 (2) dt.18-03-2016 2/2 when contact was made over mobile phone, he disclosed that he came to Nepal along with informant's son. Thereafter, no contact was made with the said Amar Kumar.

Learned counsel for the petitioner submits that the main thrust of allegation is against Amar Kumar and Amar Kumar has already been granted the privilege of bail vide order dated 10.02.2016 passed in Cr. Misc. No. 55663 of 2015. It is further submitted that the petitioner has been dragged in the present case merely on suspicion and only on the ground that the petitioner is the sister of Amar Kumar.

Considering the aforementioned facts and circumstances of the case as also that the petitioner has no criminal antecedent, let the petitioner above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., East Muzaffarpur, in connection with Mithanpur P.S. Case No. 1 of 2015.
