The petitioners seek anticipatory bail in connection with Turkauliya (Banjariya) P. S. Case No. 622 of 2018, registered for offences punishable under Sections 304-B and 201/34 of the Indian Penal Code.
Allegation as per the F.I.R. against the petitioners, who are father-in-law and mother-in-law of the deceased, is of killing the deceased due to non fulfillment of demand of dowry and disposed of her dead body.
Submission of the learned counsel for the petitioners is that during investigation, it has come that she has committed suicide and they have falsely been implicated in this case. It is further submitted that no independent witnesses has supported the prosecution version rather the victim herself committed
Patna High Court CR. MISC. No.3127 of 2019(3) dt.07-03-2019 2/2 suicide and they have no criminal antecedent. Learned A.P.P. opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances discussed above, prayer for anticipatory bail of the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Chaparan in connection with Turkauliya (Banjariya) P.S.Case No. 622 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. and one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
