JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 The petitioner seeks regular bail in connection with Bihra P.S. Case No. 266 of 2017, registered for offences punishable under Sections 3323, 324, 307, 504, 379 and 34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is of assault to the informant by means of spade causing injury to him. It has been submitted on behalf of the petitioner due to family dispute, a scuffle took place between the parties and now a compromise has been reached between the parties, which will appear from impugned order itself. Further submission is that he has no criminal antecedent and he has been in judicial custody since 06.11.2019.

Having heard both sides, in view of the above facts,

Patna High Court CR. MISC. No.5024 of 2020(2) dt.31-01-2020 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Bihra P.S. Case No. 266 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
