This application for grant of anticipatory bail arises out of Brahampur P.S. Case No.458 of 2023 registered for the offence punishable under Sections 457 and 380 of the Indian Penal Code.

The petitioner is accused of committing theft in the house of the informant. The name of the petitioner has come in confessional statement of co-accused Deepak Kumar Gupta.

Considering the fact that the petitioner has participated in the crime, I am not inclined to grant the petitioner privilege of anticipatory bail.

Accordingly, this anticipatory bail application is rejected with liberty to the petitioner to surrender

Patna High Court CR. MISC. No.4139 of 2025(2) dt.05-02-2025 2/2 before the Court below within four weeks from today and pray for regular bail. If the petitioner surrenders within four weeks from today and prays for regular bail, the Court below shall consider the same in accordance with law without being influenced by the order of this Court. While deciding the bail application of the petitioner, the Court below shall consider the fact that co-accused Deepak Kumar Gupta, who has named the petitioner, has been granted regular bail by this Court.
