JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Saraiya P.S. Case No. 343/2019 registered for the offence punishable under Section 30(a), 32(II), 38(II and 41(I) of the Bihar Prohibition and Excise Act, 2016.

In huge quantity Indian made foreign liquor was seized and one Jaglal Ram was arrested, who disclosed the name of petitioners stating that they were also involved in trade of illicit liquor.

Taking note of the averments made in the written report of the informant, in my view, this anticipatory bail

Patna High Court CR. MISC. No.5043 of 2020(2) dt.03-03-2020 2/2 petition is not maintainable. Accordingly, this anticipatory bail petition stands dismissed being not maintainable. However, petitioners are directed to surrender before the court below within six weeks from today and if they do so and seek regular bail, the concerned court shall consider the regular bail petition of the petitioners on its own merit without being prejudiced by this rejection order.
