Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Nawkothi P.S. Case No. 54 of 2021 registered for the offence under Sections 341, 323, 506, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case is that on 07.04.2021 at about 5:30 PM while the informant was going to pay Rs. 22,000/- to one Ganesh Singh, at that time, the petitioner and other accused persons stopped him and fired upon him but the informant managed to escape from the said place.
Patna High Court CR. MISC. No.5453 of 2023(3) dt.18-05-2023 2/3 Learned counsel for the petitioner submits that the petitioner is in custody since 26.02.2022.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody of the petitioner, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Begusarai in connection with Nawkothi P.S. Case No. 54 of 2021.
The District Judge, Begusarai is directed to expedite the trial of all the cases pending against the petitioner i.e. Nawkothi P.S. Case No. 184 of 2021, Nawkothi P.S. Case No.103 of 2021, Nawkothi P.S. Case No. 53 of 2021, Cheria Bariyarpur P.S. Case No. 61 of 2015 and Nawkothi P.S. Case No.54 of 2021.
This is also subject to the condition that after grant of bail, the petitioner will stay with Daulat Kumar @ Harshwardhan Kumar, Son of Late Bimal Singh @ Late Bimal Dev Singh, Mohalla-Vishal Nagar, Aundh, P.S.- Aundh, Pune, Maharashtra in the jurisdiction of Aundh Police Station, Pune,
Patna High Court CR. MISC. No.5453 of 2023(3) dt.18-05-2023 3/3 Maharashtra. He will appear before the trial Court only on the dates of the trial and thereafter, he will again go to Pune. Before leaving Pune and after reaching back, he will inform the Aundh Police Station about the same.
