For the Petitioner/s : Mr. Girish Chandra Jha, Adv. For the State : Mr. Jagdhar Pd., A.P.P. =========================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL JUDGMENT Date: 07-05-2015 Heard learned counsel for the Petitioners and the State. The Petitioners seek revision of the Judgment in Appeal dated 1.11.2014 by the Adhoc Additional Sessions Judge-4, Darbhanga, in Criminal Appeal No. 40 of 2013 arising out of C.R. Case No. 245 of 2008, T.R. No. 1066 of 2012.
It has been submitted that the Petitioners have been convicted under Sections 323, 141 and 147 of the Indian Penal Code and the maximum sentence is to the extent one year whereas the Petitioner No. 1 is concerned, he is aged about 77 years and the Petitioners No. 2 and 3 are ladies. In the interest of justice, their period of sentence be reduced to one already undergone by them.
Patna High Court CR. REV. No.291 of 2015 dt.07-05-2015 2/2 On going through the impugned Judgment, I do not find any merit in the petition.
However, accepting the proposal of the Petitioners with regard to the sentence, the sentence is reduced to the period already undergone by the Petitioners.
With this modification, the application stands dismissed.
