JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-04-2016 Heard learned counsel for the petitioners, learned A.P.P. representing the State and the learned counsel for the informant.
Petitioners seek bail in connection with Goraul (Katahara O.P.) P.S. Case No. 307 of 2015 registered for the offence punishable under Section 302/34 of the Indian Penal Code.
The accusation against the petitioners is that they assaulted Palat Rai, the father of the informant and killed him and when the brothers of the informant went to rescue, they were also assaulted.
Submission is of false implication and that there is case
Patna High Court Cr.Misc. No.9391 of 2016 (3) dt.25-04-2016 2/2 and counter case, the occurrence has taken place due to trivial dispute, there was no motive to commit the murder, there is no specific allegation against the petitioners and, as such, they deserve sympathetic consideration to which the learned A.P.P. duly assisted by the learned counsel for the informant opposes by submitting that petitioners assaulted the deceased causing his death.
In the facts and circumstances stated above, considering the allegations attributed against the petitioners, serious in nature, I am not inclined to enlarge the petitioners on bail and accordingly, their such prayer stands rejected in connection with Goraul (Katahara O.P.) P.S. Case No. 307/15 pending in the court of learned CJM, Vaishali at Hajipur. (Jitendra Mohan Sharma, J) sushma/- U T
