Mr.Umeshanand Pandit ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 Petitioner seeks regular bail in connection with Forbesganj P. S. Case No. 680 of 2019 registered for the offence punishable under Section 379 of IPC.

There is allegation of snatching of motorcycle of the informant. Petitioner is not named in the F.I.R., later on, his name transpires on the confessional statement of the co-accused. Submission of the learned counsel for the petitioner is that except the confessional statement, there is nothing against him. There is no recovery and on confessional statement, he has been remanded in three other cases. He is in custody about four months. Charge sheet has already been submitted, as such, there is no chance of tampering with the evidence.

Having heard both sides, in view of the submissions,

No.2127 of 2020(2) dt.16-01-2020 2/2 made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Araria, in connection with Forbesganj P. S. Case No. 680 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that after release, he has to appear before the police of his local area in the second week of each month, for a period of six months, so that the police may watch his conduct, otherwise his bail bond shall be cancelled. Let a copy of this order be communicated to the S.P. Araria, for needful.
