JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Jogbani ( Bathnaha) P.S. Case No. 312 of 2019 registered for the offences punishable under Sections 341, 323, 504, 506, 354(B) , 307/34 of the Indian Penal Code.

Petitioners and other F.I.R named accused having entered into the house of informant not only assaulted her son as well as her husband but also made attempt to outrage the modesty of informant.

Submission on behalf of the petitioners is that there is case and counter case between the parties and specific allegation of assault is against other F.I.R named accused and so far as

Patna High Court CR. MISC. No.1795 of 2020(2) dt.29-02-2020 2/2 petitioner no. 1 is concerned, it is only stated that he tried to outrage the modesty of informant and as a matter of fact, the aforesaid allegation has been inserted with an object to make the offence graver.

Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, keeping in mind that both the injureds have sustained simple injury and there is case and counter case between the parties, let the above named, petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Jogbani ( Bathnaha) P.S. Case No. 312 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
