JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Initially, the present case was lodged under Sections 279, 337, 338, 304(a) of the Indian Penal Code against unknown on the basis of ferdbeyan of father of the deceased, Kaushal Kumar. The father of deceased stated that his son, namely, Kaushal Kumar while going on a motorcycle along with Sanjeev Kumar Singh, met an accident as a result whereof his son and aforesaid Sanjeev Kumar Singh got injury and in course of treatment, Kaushal Kumar died.

Learned counsel for the petitioner submits that after ten days of the aforesaid occurrence, the statement of Sanjeev

No.9754 of 2016 (2) dt.01-03-2016 2/2 Kumar Singh was recorded by the investigating officer and the said Sanjeev Kumar Singh stated that it was petitioner and other accused who assaulted the deceased and him but as a matter of fact, there was several litigation between the family of petitioner as well as Sanjeev Kumar Singh and that is the reason of false implication of the petitioner in the alleged crime. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 597 of 2014.
