In this case petitioner is seek bail in Mohania P.S. Case No. 52 of 2015 registered under section 366A of the Indian Penal Code.

As per the allegation, the victim is a minor girl and the petitioner has taken away her forcibly. In her stated recorded under section 164 Cr.P.C. the victim has used a word boy without divulging the name of the petitioner but there is allegation of committing rape on her by different person. It is also alleged that petitioner and others were intending to sale the victim girl and she has heard this word herself.

Considering the aforesaid facts, this court is not inclined to grant bail to the petitioner at this stage. However, the

Patna High Court Cr.Misc. No.16900 of 2015 (2) dt.15-06-2015 2/2 petitioner will have liberty to renew his prayer for bail after completion of one year in custody.
