Learned counsel for the petitioner is directed to remove the defects, as pointed out by the Office, within a period of four weeks.
The petitioner is apprehending her arrest in a case registered under Sections 417, 418, 419, 420, 466, ,467, 468, 471, 120(B) of the Indian Penal Code.
The prosecution case in short is that the accused person committed forgery in BETET Examination, 2011 and got the appointment as teacher.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the
Patna High Court CR. MISC. No.12717 of 2019(8) dt.17-05-2022 2/2 petitioner. The petitioner has been made accused due to mistake of fact. As per the allegation, the petitioner got appointment on fake certificate. The petitioner had no knowledge that the certificate in question is a fake one. Under good faith, the petitioner applied for the post of teacher. The petitioner is a lady. On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 452/18, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
