JUSTICE SHIVAJI PANDEY ORAL ORDER 06-11-2019 In this case, the petitioner is seeking anticipatory bail in connection with Complaint Case No. 1256 of 2016 (Tr. No.2839 of 2017), registered for the offence punishable under Sections 498A/34 of the Indian Penal Code.
Both the parties are physically present and state that they are living peacefully and now there is no dispute between them.
In such view of the matter, let the petitioner, namely, Mohan Sah, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of
Patna High Court CR. MISC. No.2224 of 2019(8) dt.06-11-2019 2/2 the like amount each to the satisfaction of the S.D.J.M., Sadar Sitamarhi, in connection with Complaint Case No. 1256 of 2016 (Tr. No.2839 of 2017) subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. However, the Trial Court is directed to take necessary steps in the case looking to the situation that both the parties are living together peacefully and now there is no dispute between them.
