The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 36 and 37 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 80 litres of spirit was recovered and the petitioner along with others were taken into custody.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 27.8.2021 (Anneuxre-1) passed in Cr. Misc. no. 17477 of 2021 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the liberty granted by the aforesaid order of rejection dated 27.8.2021 and the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Piro (Hasan Bazar) P.S. Case no. 319 of 2020, Excise case no. 1874 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge -cum-Special Judge, Excise, Bhojpur at Ara.
