JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have been caught while he along with others had assembled to make preparation for committing dacoity in a Bank and in course of search, one country made loaded pistol and one live cartridge as well as one screw driver were recovered from conscious possession of the petitioner. The contention on behalf of the petitioner is that petitioner does not have any criminal antecedent and is languishing in jail custody since 27.12.2014 and, as a matter of fact, nothing has been recovered from conscious possession of the petitioner and he was arrested by the police on mere suspicion. Considering the aforesaid facts and circumstances as

No.7487 of 2016 (2) dt.17-02-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Sherghaty , Gaya in connection with Kothi P.S.Case No. 97 of 2014, subject to the condition that one of the sureties must be holder of landed property.
