Petitioner is not named in the first information report and as per submission of learned counsel for the petitioner, for the first time, the name of petitioner came in confessional statement of co-accused, Kiran Devi, who stated that co-accused Rakesh Raut was in possession of mobile phone of the petitioner and it appears that except the aforesaid material as well as confessional statement of co-accused, there appears to be nothing against the petitioner.

Accordingly, the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection

Patna High Court Cr.Misc. No.17419 of 2015 (4) dt.03-09-2015 2/2 with Bela P.S. Case No. 110 of 2013 to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi.
