JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-10-2016 Petitioner is languishing in custody since 31.8.2015 in a case registered for the offences under Sections 20 (b) ii, 21 (c), 22 and 27A of the N.D.P.S. Act.

The prosecution case is that the informant who is Officer-in-Charge of Rail P.P., Bettiah along with one another constable Binod Kumar went to railway, platform no.2 and saw a person near over bridge. On chase, petitioner was apprehended and about 2 kg. Charas were recovered from his possession. The report of the learned Additional Sessions Judge7, Bettiah, West Champaran dated 8.9.2016 reflects that four out of six charge sheeted witnesses have already been examined and the trial is likely to be conclude within six months.

Patna High Court Cr.Misc. No.9701 of 2016 (6) dt.26-10-2016 2/2 Considering the commercial quantity of recovery, this Court is not inclined to grant bail. Accordingly, the prayer for bail of the petitioner in connection with Sugauli (BTH) Rail P.S. Case No.26 of 2015 stands rejected. However, the learned trial court is expected to conclude the trial of the petitioner within the stipulated time frame transmitted to this Court. (Dinesh Kumar Singh, J) N.H./- U T
