The petitioner seeks bail in a case under Sections 395 and 412 of the Indian Penal Code.
The petitioner is not named in the FIR. The name of the petitioner figured in the case on the basis of confessional statement of co-accused Dharmendra and others. From the house of the petitioner one water pot was recovered which is said to have been identified by the informant.
It is submitted that the informant did not give any mark of identification of the water pot. The water pot is commonly used article. The other co-accused persons have already been enlarged on bail.
Considering the facts aforesaid, the above named
Patna High Court Cr.Misc. No.18683 of 2015 (2) dt.15-06-2015 2/2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Chief Judicial Magistrate, Sitamarhi in connection with Riga P.S. Case No. 106 of 2012.
