JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2019 This application, for grant of anticipatory bail, arises out of Ghosi P.S. Case No. 307 of 2018, disclosing offences under Sections 341, 323, 448, 379, 324, 147 and 307 of the Indian Penal Code.
Allegation against the petitioners and others is that they entered into the house of informant and assaulted the daughter of one Kamluddin and also taken away Rs. 20,000/- and other articles and petitioner no. 1 alleged to have taken away the earrings.
Submission of learned counsel for the petitioners is that they have falsely been made accused in this case and a proceeding under Section 107 of the Cr.P.C. is going between the parties. Moreover, no specific allegation of assault has been

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jehanabad, in connection with Ghosi P.S. Case No. 307 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
