JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 406 and 420 of the Indian Penal Code.

As per the prosecution case, the informant has purchased Jawa motorcycle from Kirat Sartaj Mothr Private Limited, the company of this petitioner and at the time of purchase on 10.06.2020, the informant has given total Rs. 2,12,0384.00 including Registration fees to petitioner but till date the motorcycle has not been registered by the company. Learned counsel for the petitioner submits that due to lockdown period in which the registration of vehicles were suspended under guidelines issued by Hon'ble Supreme Court in Civil Writ Petitioner No. 13029 of 1985 and further I.A. No. 45883 of 2020. I.A. No. 45912 of 2020 and I.A. No. 48113 of

Patna High Court CR. MISC. No.5544 of 2023(2) dt.10-04-2023 2/2 2022, it was ordered by the Apex Court regarding registration of unregistered vehicles with a short period but, in the meantime the informant has demanded to return of his bike to the informant, so that the registration has not done till now. The petitioner claims clean antecedent. The petitioner is ready to refund the amount of registration fees and also ready to get the bike registered whenever the informant so desires. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Bhojpur at Ara, in connection with Ara Nawada P.S. case no.545 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
