2. Earlier the prayer of bail of this petitioner was rejected vide order dated 16.05.2023. This is second attempt of bail.

3. The petitioner has preferred this application for grant of regular bail in a case registered under section 395 of the Indian Penal Code.

4. The petitioner is accused of committing dacoity. The petitioner is in jail since 05.08.2022. Similarly, situated coaccused persons have been granted bail vide order dated 18.05.2023 and 24.05.2023 passed in Cr. Misc. No. 18909 of 2023 and Cr. Misc. No.26246 of 2023 respectively.

5. At the outset, learned counsel for the petitioner, without accepting the guilt of the petitioner, has submitted that the petitioner is ready to compensate the informant by paying an amount of s. 50,000/- in the Court below

6. Learned counsel for the State has opposed the prayer for bail.

7. Considering the period of custody and similarly situated accused persons have been granted bail by a Coordinate Bench of this Court, this application is allowed.

8. Let the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gaya, in connection with Amas P.S. Case No. 251 of 2021.

9. At the time of furnishing the bail bonds, the petitioner shall furnish a demand draft of Rs. 50,000/- prepared in the name of the informant. If the petitioner furnishes the demand draft of Rs.50,000/- the Court below shall accept the bail-bonds of the petitioner and hand over the said demand draft to the informant.

10. The petitioner shall mark his presence in Chhakarbandha Police Station, Distt- Gaya on 1st Sunday of
