Petitioners apprehend their arrest in a case registered under Sections 341, 323,324, 307, 379, 504, 506/34 of the Indian Penal Code.

Informant in his fardbeyan has alleged that on 11.11.2019 at about 6:00 PM while he was returning from coaching classes, petitioners surrounded him. Petitioner No. 1 Rishukesh Raj assaulted by knife on his abdomen and petitioner No. 2 Anil Kumar assaulted by knife on his neck and petitioner No. 3 caught hold him, as a result of which he sustained grievous injuries.

As there is direct allegation against petitioner Nos. 1

Patna High Court CR. MISC. No.2196 of 2020(2) dt.16-01-2020 2/2 and 2 of inflicting knife blow on his abdomen and neck, I am not inclined to grant bail to the petitioner Nos. 1 and 2, accordingly, this application for grant of anticipatory bail on their behalf is rejected.

As far as petitioner No. 3 is concerned. Allegation against petitioner No. 3 is that he caught hold the informant and there is no allegation of causing any injury by him. Allegation made against him is of general and omnibus nature. Petitioner No. 3 has no criminal antecedent. Considering the facts and circumstances of the case, prayer of anticipatory bail of petitioner No. 3 is allowed and petitioner No. 3 named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner No. 3 is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Sugauli P.S. Case No. 509 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
