The petitioner seeks regular bail in connection with Bikram P.S. Case No. 295 of 2018 for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act and Section 37(b)(c) of the Bihar Prohibition and Excise Act. The allegation is regarding recovery of country made pistol, mobile etc. from the person of the accused persons, when they were apprehended by the police.
The learned counsel for the petitioner submits that the arms has been recovered from the co-accused namely, Upendra Yadav and as far as the petitioner is concerned, one mobile was recovered. The petitioner is stated to be having a fair antecedent,
Patna High Court Cr.Misc. No.4041 of 2019(2) dt.25-01-2019 2/2 except one case in which he is on bail. The petitioner is languishing in custody since 27.09.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Spl. Judge Excise, Patna in connection with Bikram P.S. Case No. 295 of 2018 (arising out of Spl. Case No. 9012 of 2018). (Mohit Kumar Shah, J) Tiwary/- U T
