The petitioner seeks bail in connection with Chiraiya P.S. Case No. 479 of 2019, registered under Section 386 of the Indian Penal Code.
The accusation is that on 01.10.2019 at about 9.00 P.M., when informant Raj Mangal Yadav came out from the house at the door then found a letter lying there through which ransom of Rs. Five Lakh was demanded on which mobile No. 9897528252 was also mentioned.
Learned counsel for the petitioner submits that petitioner is not the holder of the SIM, as detailed in the F.I.R., and he has falsely been implicated in this case merely on suspicion. Further submission is that the petitioner was
Patna High Court CR. MISC. No.1988 of 2020(2) dt.24-01-2020 2/2 apprehended by the Police, who got recorded his confessional statement showing his involvement in the present case and his name has also been shown in the confessional statement of coaccused Subodh Kumar. The petitioner has no criminal antecedent and he is in custody since 08.10.2019. The Police, after investigation, has already submitted Chargesheet against the petitioner.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Chiraiya P.S. Case No. 479 of 2019.
