JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks his bail in connection with session trial no. 194 of 2013/62 of 2013 arising out of Rafiganj P.S.Case No.189 of 2012, pending in the court of Ad-hoc Additional Sessions Judge-IV, Aurangabad.

Earlier the prayer for bail of the petitioner was rejected by a Co-ordinate Bench of this Court vide order dated 29.11.2013 passed in Cr. Misc. No.24185 of 2013. It would appear from perusal of report of trial court that the prosecution evidence has already been closed and the case has been fixed for recording the statement of accused persons.

Taking note of the aforesaid fact as well as present

Patna High Court Cr.Misc. No.27009 of 2014 (5) dt.12-01-2015 2/2 stage of the trial, I am not inclined to grant privilege of bail, accordingly, his prayer for bail is again rejected. However the trial court is directed to dispose of the session trial no. 194 of 2013/62 of 2013 as early as possible.
