JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 27.12.2014 in a case registered for the offences punishable under section 461, 379,411 Of the Indian Penal Code. The first information report was lodged against one person, namely, Bantha @ Rajiv Choudhary. Subsequently three persons were intercepted while taking a bag containing 96 mobile phones on a motor cycle but they managed to flee away. Hence suspicion was raised against the petitioner. The dog squad also indicated involvement of the petitioner in the commission of offence. It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and statement has been made in paragraph 3 that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Birpur at Supaul in connection with Birpur (Bhimnagar) P. S. case No. 163 of 2014.
