The petitioner has preferred the instant application for grant of regular bail in a case registered under section 354B of the Indian Penal Code and section 8 of the POCSO Act. As per the prosecution case, the petitioner picked up the minor informant, misbehaved with her and started to take her to the river side. It is stated that the informant's friend struck the petitioner with a stick as a result of which she got free. The accused ran away.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false and concocted. The petitioner who is a young student has been falsely implicated in the case due to oblique reasons. The parties

Patna High Court CR. MISC. No.14150 of 2021(3) dt.02-09-2021 2/2 have settled their misunderstanding. The petitioner is in custody since 27.11.2020, has no criminal antecedent and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the nature of allegations together with the petitioner having remained in custody for over 9 months, this Court directs the petitioner to be enlarged on bail in connection with Warsaliganj P.S. case no.380 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VI-cum-Special Judge, POCSO Act, Nawada.
