JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-06-2015 Heard learned counsels for the petitioner and the State. The petitioner being father-in-law of the victim is languishing in jail since 20.01.2015 in a case registered for the offences punishable under Sections 328 and 302/34 of the Indian Penal Code.

The prosecution case is that the son of the informant went to in-laws house on 01.12.2009 and on 02.12.2009, the informant received telephonic information that his son died. It was suspected that the son of the informant was killed by his in-laws family and his seventy thousand rupees and mobile were taken. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled as there is no direct evidence suggesting the complicity of the petitioner.

Patna High Court Cr.Misc. No.16930 of 2015 (3) dt.23-06-2015 2/2 Moreover, the similarly situated accused persons namely Dines Yadav and Vinod Yadav have been granted anticipatory bail vide Criminal Miscellaneous No. 13288 of 2014 and the investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bonds of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui in connection with Sikandra P.S.
