The petitioner seeks bail in connection with Manjhagarh P. S. Case No. 79 of 2014 dated 21.04.2014 instituted under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. This is the second attempt for bail as earlier such prayer was rejected by order dated 04.09.2014 in Cr. Misc. No 26312 of 2014.

By order dated 16.03.2016, the Court had called for a report from the court below with regard to the status of the case and the reason why the trial has not been concluded and also the likely time by which the same can be concluded. Pursuant to the same, a report has been submitted by the Additional District and Sessions Judge-VIII, Gopalganj, under Letter No 191 dated 19.03.2016, in

Patna High Court Cr.Misc. No.19958 of 2015 dt.13-04-2016 2/2 which reasons have been mentioned and further it has been stated that the trial of the case is likely to be concluded within six months. In view of the fact that no fresh ground warranting grant of bail to the petitioner has been urged, the Court is not inclined to release the petitioner on bail. Accordingly, the application stands dismissed.

However, as has been communicated by the court below that the trial is likely to be concluded within six months, the Court deems it appropriate to direct the court below to ensure that the trial is concluded latest by 30.09.2016 positively for which it shall exercise all powers under law including fixing short dates in the case. The Superintendent of Police, Gopalganj is also directed to ensure that the prosecution witnesses are produced before the court for their examination on the dates fixed.

Registry shall communicate the order to the court below and the Superintendent of Police, Gopalganj by Fax also latest by 18.04.2016.
