JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code.

Petitioner is said to have given dagger blow causing death of informant's father but submission on behalf of the petitioner is that petitioner is an old man aged about 75 years and as a matter of fact, the present occurrence took place on account of land dispute and moreover, only single blow was given by the petitioner to deceased.

Considering the aforesaid submissions as well as facts and circumstances of the case, I am not inclined to release

Patna High Court Cr.Misc. No.14772 of 2016 (5) dt.17-08-2016 2/2 the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 679 of 2015 arising out of Jalalpur P.S. Case No. 113 of 2015 pending in the court of Additional Sessions Judge-VI, Saran at Chapra stands rejected.
