Petitioner seeks bail in connection with Mahua P.S. Case No. 463 of 2014 registered for the offences punishable under Sections 420, 419, 467, 468, 471 & 120-B of the Indian Penal Code.
Allegedly acting on a tip-off, raid was conducted and the petitioner and co-accused Ravi Kumar were caught and after search from bag of the petitioner, about sixteen seals of different officials were recovered whereas, from possession of co-accused several documents and identity cards were recovered. Submission is of false implication and that the petitioner is aged about 80 years. He has been made victim of the circumstances. He is suffering in custody since 13.11.2014.
Patna High Court Cr.Misc. No.8817 of 2015 (2) dt.10-04-2015 2/2 Chargesheet has already been submitted and there is no chance of tampering with prosecution evidence and as such the petitioner deserves sympathetic consideration.
Learned A.P.P. opposes the prayer for bail by submitting that the petitioner is indulged in such activities from earlier.
In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned C.J.M., Vaishali at Hajipur arising out of Mahua P.S. Case No. 463 of 2014 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
