Mr.Kalyan Shankar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 25-01-2019 Heard both sides.

The petitioner apprehends his arrest in Bodh Gaya P.S. Case No.13 of 2018 registered under Sections 370 and 120(B) of the Indian Penal Code and Sections, 3, 5, 6 and 7 of the Immoral Trafficking Act and Section 14 of the Foreign Act. The police raided Madhuvan Palace Hotel, Bodh Gaya and recovered four girls. Two girls from Room No.207 and two girls from Room No.208. The girls disclosed that the owner of the hotel, in collusion with other brought them in the hotel for flesh trade.

Learned counsel for the petitioner submits that the petitioner is of course the owner of the hotel but nobody has named the petitioner. The victim girls made their statements under Section 164 of the Cr.P.C. and they disclosed the name of

Patna High Court Cr.Misc. No.3723 of 2019(2) dt.25-01-2019 2/2 one Guddu as the owner of the hotel.

It appears that the petitioner is the real owner of the said hotel and under his nose, flesh trade was going on in his hotel.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
