The petitioner seeks bail in S.Tr. No. 591/2018, arising out of Bhagwanpur P.S. Case No. 185/2018, instituted for offences under Section(s) 341, 323, 379, 307, 354 and 504 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the instant case has been filed as counter blast of Bhagwanpur Hat P.S. Case No. 186/2018, which has been filed by the petitioner for offence under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code against informant and one Mukesh Sah.

It is alleged in the instant case that on the date of occurrence petitioner assaulted the wife of informant. When

Patna High Court Cr.Misc. No.2736 of 2019(2) dt.22-01-2019 2/2 informant went to enquire the matter petitioner gave him knife blow causing injury on his head.

Injury report is annexed as Annexure-3 from which it appears that injury sustained by informant is simple in nature caused by hard and blunt substance.

Petitioner is in custody since 04.09.2018 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge IIIrd, Siwan in connection with S.Tr. No. 591/2018, arising out of Bhagwanpur P.S. Case No. 185/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
