The petitioner seeks regular bail in connection with Spl. Case No.982 of 2019 arising out of Fulkaha P.S. Case No.119 of 2019 registered for offences punishable under Sections 30(a)/45 of the Indian Penal Code.

There is recovery of more than 621 ltrs. of liquor and the petitioner is said to be working as liner in this case and apart from that he is accused in three other cases . Submission of the learned counsel for the petitioner is that the FIR itself show that nothing has been recovered from his possession. He is in custody for more than three months. Charge-sheet has already been submitted.

Heard learned A.P.P. also.

No.9031 of 2020(2) dt.03-03-2020 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge cum Spl. Judge, Araria in connection with Spl. Case No.982 of 2019 arising out of Fulkaha P.S.Case No.119 of 2019 with condition that he has to appear before the local police station of his area for a period of six months so that the police may watch his conduct and his activities and if he is found involved in such type of cases or in any other cases in future, the prosecution is at liberty to move for cancellation of his bail bond.

With the above direction, this application is allowed.
