JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor, appearing on behalf of the State.

The petitioner is in custody in connection with Teghra P.S. Case No. 323/2014 registered for the offence under section 302/34 of the Indian Penal Code.

Petitioner is father-in-law of the deceased. As per the prosecution case the informant's daughter and the petitioner's son had married each other.

Learned counsel for the petitioner submits that it has wrongly been mentioned in the F.I.R. that the marriage had taken place six years ago rather they were married more than ten years ago. This fact has come during the course of investigation.

Patna High Court Cr.Misc. No.8349 of 2015 (2) dt.10-04-2015 He has further submitted that according to the F.I.R. there is no allegation of any overt act against the petitioner. In view of the submissions as above, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Teghra P.S. Case No. 323 of 2014.
