The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Bakhtiyarpur P.S. Case No.393 of 2018, registered for the offence punishable under sections 420, 467, 468, 471, 120B and 34 of the Indian Penal Code.

As per allegation in the F.I.R., it is stated by the informant that the accused persons came to his land and started to measure the same. The informant objected to the measurement for the reason that the said piece of land had been purchased by his ancestors and on partition in his family, the same had fallen in his share. It is further stated that two persons including the petitioner herein, who have been habitual

It is further stated that they threatened the informant that he will have to give Rs 10 lacs by way of 'rangdari' as the accused persons had spent almost Rs. 5 lacs in creating forged documents.

It is submitted by learned counsel for the petitioner that from the F.I.R. itself it would transpire that the allegation is one of purely land dispute between the parties. It is further submitted that the petitioner had got the land by way of gift from one of his relative and he has right, title and interest on the land in question. It is further submitted that the allegations of demand of rangdari etc are false and concocted. It is submitted by learned counsel for the informant that the petitioner is named in the F.I.R. and there is direct and serious allegation against him and thus it is not a fit case for grant of anticipatory bail.

Having heard learned counsel for the parties and taking into consideration the nature of allegations, as narrated in the F.I.R, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of six weeks from today and in the event of his arrest or surrender in connection with Bakhtiyarpur P.S. Case No.393 of

No.3391 of 2020(2) dt.06-03-2020 3/3 2018, he will be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Barh subject to the condition as laid down under section 438(2) of the Cr.P.C.
