From perusal of the office notes, it appears that the notice has been validly served upon the respondent no. 2 but nobody appears on his behalf.

It is submitted by learned Spl.P.P. for the State that cognizance has been taken against the appellant in this case. Considering the fact that cognizance has been taken against the appellant, this appeal is dismissed as not maintainable in view of the judgment of the Apex Court in the case of Bachu Das vs. State of Bihar and others reported in (2014) 3 Supreme Court Cases 471.
