Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. In the present case, the petitioner seeks bail in connection with Digha P.S. Case No. 341 of 2020 registered for the alleged offences under Sections 307, 341, 354B and other minor sections of the Indian Penal Code.
The prosecution case is that the petitioner along with other co-accused persons repeatedly assaulted the informant and his family members.
Learned senior counsel for the petitioner has submitted that there is general allegation against the petitioner
Patna High Court CR. MISC. No.5714 of 2022(2) dt.13-06-2022 2/3 and co-accused persons and nothing specific has been attributed against the petitioner. Moreover, there is no specific allegation either under section 307 IPC or 354B IPC against the petitioner. Further, matter has been compromised between the parties and no useful purpose will be served by keeping the petitioner behind the bar in the present case and other co-accused persons have been granted privilege of anticipatory bail. Petitioner is in custody since 02.12.2021.
Learned APP has opposed the prayer for bail.
Having regard to the submission made hereinabove and considering the period of custody, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Sub divisional Judicial Magistrate, Patna/court concerned in connection with Digha P.S. Case No. 341 of 2020, subject to the following conditions: (i) One of the bailors will be a close relative of the petitioner, preferably one of the parents.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence for three consecutive dates or in violation of the terms of the bail, the bail bond of the
