The victim in her statement recorded under section 164 of the Cr.P.C. has stated that she had solemnized marriage with the petitioner and she wants to live with him. The victim disclosed her age as 19 years whereas the learned Magistrate, who recorded the statement of victim under section 164 of the Cr. P.C., assessed her age as 18 1⁄2 years.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. case No.739 of 2015.
