The petitioner being the Cleaner of a Tata Magic vehicle is languishing in custody since 12.12.2014 in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

From a Tata Magic vehicle 40 bags of wheat were recovered which was found to be of PDS dealer Rabindra Nath Mandal when it was suspected that the grains were being transported for black-marketing.

It is submitted by learned counsel for the petitioner that the petitioner is Cleaner of the public carrier and the thrust of accusation is against PDS dealer. The investigation has

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Munger in connection with Naya Ramnagar P.S. Case No. 169 of 2014.
