JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-03-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is languishing in jail since 16.11.2015 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 379 and 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

The basic accusation is of torture for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioner that on assurance of the petitioner that he will keep the complaint as wife with full dignity and honour, the petitioner was granted provisional anticipatory bail vide Cr. Misc. No. 24635 of 2012 but subsequently bail bonds of the petitioner were cancelled.

Patna High Court Cr.Misc. No.11508 of 2016 (2) dt.09-03-2016 2/2 Considering the nature of accusation, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Jhanjharpur in connection with C.R. No. 104 of 2011.
