Petitioner was neither caught on the spot nor anything was recovered from his conscious possession and the name of the petitioner came in this case in the confessional statements of coaccused who were caught on the spot. Moreover, it appears that except the aforesaid confessional statements of co-accused and some criminal antecedent of the petitioner, there is nothing against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Jamhore P.S. Case no. 69/2015.
