1. Heard learned counsel for the petitioner and learned APP for the State.

2. Petitioner seeks regular bail in connection with Sahebpur Kamal (S. Kamal) P.S. Case No. 188 of 2021, dated 04.08.2021, registered for the offences punishable under Sections 120(B), 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

3. The main submissions advanced by petitioner's counsel are that the instant matter relates to the recovery of 272.880 Liters of country-made english wine which is stated to have been made from the house of the petitioner's father as per seizure list and the said recovery was not made from the conscious possession of this petitioner and petitioner's father has also been made accused in this case who is carrying similar

Patna High Court CR. MISC. No.7286 of 2023(2) dt.01-05-2023 2/2 nature of allegation, has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No. 68443 of 2021. Further submissions are that the petitioner has been languishing in jail since 14.11.2022 having fair and clean antecedent and against him the investigation has been completed.

4. Learned APP appearing for the State has opposed the prayer for bail.

5. Considering the above submissions and mainly the privilege of bail having been granted to similarly situated coaccused by co-ordinate Bench of this Court mentioned above coupled with this fact that the petitioner has fair and clean antecedent and against him the investigation has been completed, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Sahebpur Kamal (S. Kamal) P.S. Case No. 188 of 2021.
