JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-08-2024 The present writ petition has been filed seeking the following relief:- "1 i. For issuance of a writ of mandamus directing the respondent No.6 to allow and process the registration of sale deed to be executed by the petitioner, who is absolute owner of the property admeasuring 5.01 acre situated at Village- Sobha Khap, P.S.- Magadh University, DistrictGaya, Thana No. 425, Sub-Division and Registry Office Gaya, more particularly described in Paragraph No. 6 of this writ application."

2. At the outset, the learned counsel for the respondent-State submits that the restriction imposed regarding transfer of the land in question, appertaining to Khata No.97,

Patna High Court CWJC No.2934 of 2024(4) dt.22-08-2024 2/2 Plots No.758 and 759, Thana No.425, situated at village-Sobha Khap, P.S.-Magadh University, Circle-Boghgaya, District-Gaya has been removed, hence the present writ petition has been rendered infructuous.

3. Per contra, the learned counsel for the petitioner submits that the Registrar, Registration Officer, Gaya Sadar be directed to ensure that the sale deed with regard to the aforesaid land in question is registered, as and when presented.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the respondent no.6, i.e. the Registrar, Registration Officer, Gaya Sadar to ensure registration of the sale deed with regard to the aforesaid land in question, upon completion of all the formalities and payment of requisite stamp duty/registration charges, as and when the same is presented for registration.

5. The writ petition stands disposed off on the aforesaid terms.
